Terms of Service

These Terms of Service ("Terms") govern your use of the Pill Counter mobile application ("App") operated by App Harbour ApS ("we," "us," or "our").

By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal or professional purposes, subject to these Terms.

Accuracy Disclaimer

THE APP USES ON-DEVICE MACHINE LEARNING TO ASSIST WITH PILL COUNTING. THE COUNTS PROVIDED BY THE APP ARE ESTIMATES AND MAY NOT BE 100% ACCURATE. YOU MUST ALWAYS VISUALLY VERIFY THE COUNT BEFORE RELYING ON IT.

The App is a counting assistance tool only. It is:

• Not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or medical condition
• Not a substitute for professional judgment, manual verification, or established pharmacy counting procedures
• Not approved or regulated by the FDA, EMA, or any health regulatory body

You assume full responsibility for verifying all counts produced by the App. App Harbour ApS is not liable for any errors in counting, whether caused by lighting conditions, pill arrangement, device limitations, or any other factor.

Subscriptions

Available Subscriptions

The App offers the following auto-renewable subscription products:

• Weekly Premium: 1-week subscription with a 3-day free trial
• Annual Premium: 1-year subscription

Subscription Terms

• Free Trial: Weekly Premium includes a 3-day free trial. You will not be charged during the trial period. After the trial, the subscription will automatically convert to a paid weekly subscription unless canceled.
• Automatic Renewal: Subscriptions automatically renew at the end of each period unless canceled at least 24 hours before the renewal date.
• Payment: Payment will be charged to your Apple ID account at confirmation of purchase or after the free trial period.
• Cancellation: You can cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period.
• Refunds: Refunds are handled according to Apple's App Store policies. Contact Apple support for refund requests.
• Restore Purchases: You can restore your subscription on other devices using the "Restore Purchases" feature in the App.

Managing Subscriptions

To manage or cancel your subscription:

1. Open the Settings app on your iOS device
2. Tap your name at the top
3. Tap "Subscriptions"
4. Select Pill Counter
5. Make changes or cancel

Acceptable Use

You agree not to:

• Use the App for any illegal or unauthorized purpose
• Attempt to reverse engineer, decompile, or disassemble the App
• Remove, alter, or obscure any proprietary notices in the App
• Use the App in a way that could damage, disable, or impair its functionality
• Attempt to gain unauthorized access to any part of the App

Intellectual Property

All content, features, and functionality of the App, including but not limited to text, graphics, logos, and software, are owned by App Harbour ApS and protected by copyright, trademark, and other intellectual property laws.

Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

• The App will be uninterrupted, secure, or error-free
• The results obtained from using the App will be accurate or reliable
• Any errors in the App will be corrected

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, APP HARBOUR APS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OR INABILITY TO USE THE APP.

Changes to the App

We reserve the right to modify, suspend, or discontinue the App (or any part thereof) at any time with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the App.

Changes to These Terms

We may update these Terms from time to time. Changes will be posted within the App with an updated effective date. Continued use of the App after changes constitutes acceptance of the updated Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Denmark, without regard to its conflict of law provisions.

Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including breach of these Terms.

Upon termination:

• Your right to use the App will immediately cease
• Active subscriptions will continue until the end of the current billing period unless refunded by Apple
